MEDIATION

Trained in mediation since January 2021, Marie Frisch is regularly appointed as a mediator in conventional and judicial mediations.  

Alternative to judicial practice, the mediation is a confidential process involving an independent, neutral and impartial third party, the mediator. Besides the speed and the confidentiality of the process, mediation provides the valuable advantage of pragmatic, efficient and long-term solution that is not imposed by a judge.

 

Mediation promotes a global approach to the conflict in its economic aspects but also human, technical and pragmatic ones. 

In any case, the lawyers participation to the procedure and to the drafting of the settlement agreement resulting from mediation is always preferred. 

Since the 2019 United Nations Convention on International Settlement Agreements Resulting from Mediation (the "Singapore Convention on Mediation"), mediation has been considerably increasing in the context of international commercial dispute resolutions.
